1. Acceptance of Terms

By accessing or using Servobar at servobar.com ("the Service"), you agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree, do not use the Service. These Terms are between you and Pourmatix Inc ("Company", "we", "us", or "our").

2. Description of Service

Servobar is a cocktail machine management platform that allows operators and users to manage recipes, monitor machine inventory, control automated beverage dispensing equipment, and receive notifications about machine status. Features are subject to change at our discretion.

3. Eligibility

You must be at least 21 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that your use of the Service complies with all applicable laws and regulations, including those relating to the sale and service of alcohol in your jurisdiction.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account at support@pourmatix.com.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

5. Machine Operation and Alcohol Service

Servobar machines dispense alcoholic beverages. You are solely responsible for ensuring that your use of any Servobar machine complies with all applicable federal, state, and local laws, including laws governing the sale, service, and consumption of alcohol.

Pourmatix Inc is not responsible for any injury, damage, or liability arising from the improper operation of a machine, the service of alcohol to minors, or any violation of applicable law.

6. SMS Communications

By providing your phone number and opting in to SMS notifications, you consent to receive text messages from Pourmatix Inc. Message types include machine alerts, inventory notifications, and promotional messages. Message and data rates may apply.

You may opt out at any time by replying STOP to any message or updating your preferences at servobar.com/account. For help, reply HELP or email support@pourmatix.com.

7. Recipes and User Content

You retain ownership of recipes and content you create on the Service. By submitting content for public approval, you grant Pourmatix Inc a non-exclusive, royalty-free license to display and distribute that content within the Service.

You agree not to submit content that is unlawful, infringing, or otherwise objectionable. We reserve the right to remove any content at our discretion.

8. Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit spam, malware, or other harmful content
• Impersonate any person or entity

9. Intellectual Property

The Servobar name, logo, and all platform software, designs, and content created by Pourmatix Inc are the exclusive property of Pourmatix Inc and are protected by copyright, trademark, and other intellectual property laws. You may not use our marks without prior written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POURMATIX INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Pourmatix Inc and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

14. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by posting the revised Terms on this page and updating the effective date. Continued use of the Service after changes constitutes your acceptance of the new Terms.
